Terms & Conditions

H E Phillips Ltd Website Terms & Conditions

Welcome & Agreement to Our Terms

Welcome to the H E Phillips Ltd website. These Terms & Conditions outline the rules and guidelines for using our website and making purchases from us.

By accessing or using our website, or by placing an order, you agree to be bound by these Terms & Conditions. They form the entire agreement between you and H E Phillips Ltd regarding your use of our site and any purchases you make. We may update these terms periodically, so please review them before each new purchase.

Any contracts or disputes related to your use of this website or purchases made through it are governed by English law and fall under the exclusive jurisdiction of the English courts.

Online Shopping & Product Representation

We take great care to display our products as accurately as possible. However, the colours and details you see on screen may vary slightly depending on your monitor's display and colour capabilities. Therefore, we can't guarantee that the product images you see are an exact match to the actual merchandise.

Before placing an order, we encourage you to also review our dedicated:

  • Delivery Information
  • Returns Policy

These pages contain important details about your order and form an integral part of these Terms & Conditions.

Payment & Security Checks

All credit, debit, and charge card payments are subject to validation and authorisation by your card issuer. We can't be held responsible for any delay or non-delivery if your card issuer refuses to authorise payment to us.

To protect against fraudulent use of payment cards, H E Phillips Ltd will validate the names, addresses, and other information you provide during the order process against commercially available records (like Electoral Roll data or Credit Reference Services). These checks may be carried out by a third party on our behalf. By placing an order on the H E Phillips Ltd website, you consent to these checks being made.

We may need to contact you by letter, telephone, or email to verify details before we can process and dispatch your order. If we can't verify details, we may be unable to accept your order. Any information you provide will be treated in strict accordance with current UK data protection laws (e.g., GDPR). These measures are in place to enhance your security and ensure your online shopping experience with us is as safe and secure as possible.

Website Information Accuracy

We strive to ensure that all information on our website is as accurate, complete, and reliable as possible at all times. However, sometimes information may contain incomplete data, typographical errors, or inaccuracies.

Any errors are completely unintentional, and we apologise if erroneous information is reflected in a product's price or availability. We present our content 'as is' and reserve the right to correct any errors or update product information at any time without prior notice. Our goal is always to provide you with the most accurate details for your shopping experience.

Orders

Once you've completed the checkout process, we'll send you an order confirmation email detailing the products you've ordered. Please note: This email is an acknowledgement of your order and not an acceptance.

Order acceptance, and the formation of a contract between you and H E Phillips Ltd, occurs when we dispatch your ordered products. We'll notify you if we're unable to accept your order.

Reasons for non-acceptance of an order may include:

  • The product you ordered is unavailable in stock.
  • Our inability to obtain authorisation for your payment.
  • The identification of a pricing or product description error.
  • You don't meet the eligibility criteria (e.g., being under 18 years of age).
  • Your order doesn't pass our verification checks.

When your order is placed, the funds for your order will be 'pending' and set aside from your available balance. The amount isn't fully debited until the day your order is dispatched. Goods won't be dispatched until payment collection has been successful.

We can't accept orders from anyone under the age of 18. Orders placed using a debit/credit card must be from within the United Kingdom. Unfortunately, we don't accept non-UK credit or debit cards. We do accept PayPal payments.

All orders received online at H E Phillips Ltd are processed promptly. Depending on stock availability, orders are normally delivered within 1-3 working days. For items that qualify for Express Delivery, they'll usually arrive within 1-2 working days. If any products have a longer delivery time (e.g., over 48 hours), our client support team may contact you by email to confirm the approximate dispatch date. All stated delivery times are subject to order approval.

Cancellations

If you change your mind about a purchase made through our website or by phone, you have the right to cancel your order within 30 days from the day after the item was delivered to you.

To be eligible for a full refund of the purchase price and any standard outbound delivery costs, the item must be returned to us unused, in its original packaging, and accompanied by a valid proof of purchase. Please note:

  • Any costs for non-standard delivery charges won't be refunded.
  • You will be responsible for the cost of returning the item to us.

We're also happy to exchange your item within 30 days from the date of dispatch. If you choose to exchange an item outside of this 30-day refund period, a refund won't be offered for the exchanged item unless the product is faulty. Your statutory rights regarding faulty goods remain unaffected.

Missing Parcels or Items

If your parcel hasn't arrived within 5 working days from receiving your dispatch email, please contact our team immediately. It's crucial that we're made aware of missing parcels within 5 days of the dispatch email to allow us to investigate effectively and pursue compensation from the courier where necessary.

If you receive your parcel and believe something is missing, please contact our team immediately (within 2 days of receiving your delivery). Please retain all packaging until the matter is resolved.

Notifications received outside of the specified periods may unfortunately prevent a thorough investigation, and any claim against us for the lost or missing item may be rejected.

UK Deliveries

For all UK orders placed before midday, we aim to deliver your order within 3 working days. Where it's not possible to meet these timescales, we'll notify you promptly and advise you of an anticipated delivery date.

For more detailed information on delivery options and timescales, please refer to our dedicated Delivery Information page.

This site is provided on an "as is" basis, and H E Phillips Ltd makes no warranties or representations of any kind regarding this site or its content. We also make no representations or warranties about the accuracy or completeness of the information presented on this site. These disclaimers do not exclude H E Phillips Ltd's liability for matters that cannot be excluded under applicable national law.

Neither H E Phillips Ltd nor its directors, employees, or agents will be liable for damages arising from or in connection with the use of this site. This is a comprehensive limitation of liability that applies to all damages, including (without limitation) compensatory, direct, indirect, or consequential damages, loss of data, income or profit, loss or property damage, and claims by third parties.

Please note: H E Phillips Ltd does not exclude any liability for death or personal injury resulting from its negligence or the negligence of its directors, employees, or agents.

H E Phillips Ltd cannot be responsible for any losses you may incur when transmitting information to us via internet link or email. Any such loss shall not be borne, either wholly or partly, by us and remains entirely your responsibility.

Important Note: This revised Terms & Conditions document is a clear and well-structured version based on our previous discussions. However, it is crucial to have it reviewed and approved by a qualified legal professional to ensure full compliance with all relevant UK consumer and trading laws (such as the Consumer Rights Act 2015, Consumer Contracts Regulations 2013, etc.) and to adequately protect your business.
